By accessing or using AquaNest ("the Service", "the Game"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, players, and/or contributors of content.

AquaNest is a casual browser-based game that allows users to build and manage a virtual aquarium. Users can buy fish, watch them grow, harvest coins, purchase decorations, and customize their aquarium experience.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. Game progress, virtual items, and virtual currency have no real-world monetary value.

3.1 Account Creation

You may use the Service anonymously or create an account using Google authentication. If you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept all responsibility for activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem necessary to protect the Service.

The Service may include virtual currency ("Coins") and virtual items ("Fish", "Decorations"). You acknowledge that:

• Virtual items and currency have no real-world monetary value
• Virtual items are licensed, not sold, to you
• We may modify, remove, or reset virtual items at any time
• Purchases of virtual currency are final and non-refundable except as required by law
• Virtual items cannot be transferred, sold, or exchanged outside the Service

The Service may offer optional in-app purchases through third-party payment processors (e.g., Gumroad). By making a purchase:

• You represent that you are authorized to use the payment method
• You agree to pay all charges at the prices then in effect
• All purchases are final unless otherwise required by applicable law
• Refunds are subject to the payment processor's policies

You agree not to:

• Use cheats, exploits, automation software, bots, or any unauthorized third-party tools
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble the Service
• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Collect or harvest user data without consent

The Service and its original content, features, and functionality are owned by AquaNest and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any material from the Service without prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not guarantee that any content or virtual items will be preserved indefinitely.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AQUANEST, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us, if any, in the 12 months prior to the claim.

You agree to defend, indemnify, and hold harmless AquaNest and its affiliates from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration where permitted by law.

We reserve the right to modify these Terms at any time. Changes are effective when posted. Continued use of the Service after changes constitutes acceptance of the new Terms.
